The Fortune Scholarship Program General Terms & Conditions
By registering and/or accessing this site you agree to the terms and conditions listed here. If you enter a scholarship as part of the Fortune Scholarship program you agree that you are enrolled, or will be enrolled within the next 12 months, in a college or university in the United States or that you are enrolled for the upcoming school year.
If you are not currently enrolled you agree that you are a high school, middle school or non-traditional student planning on enrolling in a college or university in the United States. You agree to let us use your name and testimonials to promote this site should you be awarded a scholarship.
You agree that if you win, you will be required to provide a testimonial for this website as well as all required information for processing the check within 14 days of being notified. Your picture may be used if you agree, but use of a picture is not required by these terms.
Free scholarships will be awarded to Houston, Texas residents only and surrounding areas.
The Fortune Scholarship Scholarship Foundation is owned by Fortune Spark in Houston, TX operated by Fortune Spark, and Live Faith Media and their sponsors and affiliates. The Fortune Scholarship Foundation is provided subject to compliance with the terms and conditions of this Applicant agreement ("Applicant Agreement").
Please read this Applicant Agreement carefully before accessing or using the Fortune Scholarship Foundation. By accessing or using the Fortune Scholarship Foundation, you agree to be bound by the terms and conditions set forth below, as if you had actually signed them. If you do not agree to the terms and conditions set forth below, you may not use the Fortune Scholarship Foundation. If you use the Fortune Scholarship Foundation, you acknowledge and agree that this Applicant Agreement is a legally binding contract between you and Fortune Spark. Fortune Spark may modify the terms and conditions in this Applicant Agreement as described below. You agree to review the Applicant Agreement often to familiarize yourself with such modifications.
By completing the registration process, you become an authorized user of the Fortune Scholarship Foundation (an "Applicant").
Section 1) Eligibility The Fortune Scholarship Foundation is limited to individuals that are recent high school graduates in Houston, TX and surrounding areas only; Corporations or other business entities may not become Applicants. The Fortune Scholarship Foundation is limited to one submission per individual, even if individual has multiple e-mail addresses. Applicants using automated services, scripts, or other processes are stricly prohibited from participating in the Fortune Scholarship program.
Applicant must be 18 years of age or older to be eligible to win a free college scholarship through the Fortune Scholarship Foundation. Applicants under 18 would need parental consent.
Applicant must be a legal resident of the City of Houston, and surrounding areas.
Section 2) Applicant Registration Obligations Equipment. In order to access and use the Fortune Scholarship Foundation, Applicants need computer equipment and telecommunications access necessary to connect to and access the World Wide Web. Applicants must provide, at Applicant's own expense, all equipment, all services (including, where applicable, telephone service) and all related third-party service fees such as ISP charges) necessary to access the Fortune Scholarship Foundation and any future enhancements or additional services.
Application Data. In consideration of use of the Fortune Scholarship Foundation, Applicant agrees to provide to Fortune Spark and its third-party partners true, accurate, current, and complete information as prompted by this Web site's online application's process. If Applicant provides any information that is untrue, inaccurate, not current, or incomplete, Fortune Spark may suspend or terminate Applicant's information and Applicant will be banned from future access.
Section 3) In order to prevent unauthorized activity, to access the Fortune Scholarship Foundation, Applicants must submit all required documents online only.
Applicant agrees to immediately notify Fortune Spark of any unauthorized use of Applicant's e-mail address and password or any other breach of security related to this Web site or the Fortune Scholarship Foundation.
Applicant agrees to abide by all applicable local, state, federal, and international laws and regulations with respect to Applicant's information. Fortune Spark cannot and will not be liable for any monetary expense cost to the applicant during the registeration process.
Section 6) Participation in community service of volunteering.
Applicant's is not in any way required to perform any community service to receive an adavantage for award selection process. Any and all programs are optional and in no way are dependent on the award selection process. Applicants may voluntarily perform in a non-profit roles, services, or programs at their own discretion. Fortune Spark shall not be a party to, or in any way responsible for, any contractual arrangements or other transactions that occur between Applicant, on the one hand, and a Client or Sponsor, on the other hand. Applicant is responsible for complying with any rules or terms set forth by Client or Sponsor. In anyway, shape or form, while applicants are volunteering or performing a community service under Fortune Spark programs, the Applicant agrees that Fortune Spark shall not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings between Applicant and Volunteer Clients or Sponsors, or as the result of an body, physical or non-physical injury.
Note: Each school year, one (1) scholarship will be awarded to one exceptional student that displays academic excellence. No substitution or cash equivalent of award permitted. Tax liability, if any, is the sole responsibility of the winner. Submission of your application is your full unconditional acceptance of and agreement to these Official Rules. Application entry constitutes your permission (or your parents' permission if you are under the age a majority) to release the entry and all information contained therein to Sponsor. Scholarship entry is open only to Houston, Texas residents and all surrounding areas and are recent high school graduates. You are responsible for any costs of entering, including any online access charges or postage.
Selection of winner; release. The winner will be determined by a review from our selection committe. The winner will be a student that shows excellent academic exellence and also the best written essay. The winner must agree to the use of his or her name, voice, and likeness for the purpose of advertising, trade or promotion by Fortune Spark. without further compensation, unless prohibited by law.
Notification of winner. The scholarship program winner will be notified by website announcement on www.Fortune Scholarship.com for each drawing. Winners will have 3 business days to contact the Fortune Scholarship program to claim their award before it is then awarded to the first runner-up in the same manner. award is not "claimed" until the winner responds with the information required for processing the winnings check within 3 business days of drawing date. All decisions are final and binding. Any award notification returned as unreachable, unclaimed, undeliverable or otherwise invalid will result in disqualification and a new winner will be selected from a randomly generated list of runners-up. The winner must contact Sponsor as instructed in the notice to the winner and may be required to sign an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release within 7 days after the date the notice is sent in order to claim his or her award. Failure to complete these steps within that 7-day period will disqualify the winner and a new winner will be selected from eligible entries in a commercially reasonable period. No exceptions will be made to this rule. Sponsor is not responsible for and will not be liable for late, lost, misdirected or unsuccessful efforts to notify the winner. The name of the awardwinner will be posted at www.FortuneScholarship.com. Each award is one check issued by Fortune Spark, co-payable to the winner and the college the winner will attend, and given directly to the winner.
Each semester for 1 school year, the winner will be awards $500.00 USD. Winner is responsible for all providing proof that money was used for educational pursuits. Which includes receipts, tax forms, tuition records, etc... Award is not transferable.
Finally you (the applicant) agree to release and hold Fortune Spark, its sponsors, its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the receiving of this award.
. Resolution of disputes. Except where prohibited by law, as a condition of participating in this scholarship program you agree that (I) any and all disputes and causes of action arising out of or connected with the scholarship program or any awards awarded, shall be resolved individually, without resort to any form of class and/or legal action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office (II) the Federal Arbitration Act will govern the interpretation, enforcement and all proceedings at such arbitration; and (III) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than your actual out-of-pocket expenses (i.e., costs associated with entering the scholarship program), and you further waive all rights to have damages multiplied or increased.
Choice of law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Fortune Spark Scholarship in connection with the scholarship program, will be governed by, and construed in accordance with, the substantive laws of the State of Texas without regard to Texas choice of law provisions.
Applicant acknowledges that the content of this Web site and the Fortune Scholarship Foundation - including but not limited to text, sound, photographs, graphics, software or other material contained in either Fortune Spark Scholarship Foundation - is copyrighted by Fortune Spark and/or its licensors and suppliers (including public internet information under search engines such as Google, Bing, Yahoo...) under United States and international copyright laws, is subject to other intellectual property and proprietary rights and laws, and is owned by Fortune Spark or its licensors and suppliers (including public internet information). Such content may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, or redistributed in any way without the prior written permission of Fortune Spark
Applicant acknowledges and agrees that the Fortune Scholarship Foundation and any necessary software provided by Fortune Spark. or its Sponsors, Clients, Reward Partners or other third-party partners and used in connection with the Services ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws.
Applicant understands that all goods and services offered through the Fortune Scholarship Foundation are offered by privately owned institutions and independent third parties, and that Fortune Spark. does not operate, control or endorse any information, goods or services in any way.
Neither Fortune Spark. nor its officers, directors, stockholders, subsidiaries, employees, agents, licensors, affiliates, or other third-party providers shall be held liable for any damages or losses, whether direct, indirect, incidental, special, consequential or exemplary damages resulting from: The use or inability to use the Fortune Scholarship Foundation;
The cost of procurement of substitute goods or services;
Any transaction entered into or through the Fortune Scholarship Foundation;
The reliance on or use of any information, goods, services or merchandise provided on the Fortune Scholarship Foundation;
Unauthorized access to or alteration of Applicant's transmissions or data;
Statements or conduct of any third party;
Any claim attributable to errors, omissions or other inaccuracies in the Fortune Scholarship Foundation and/or materials or information retrieved through the Fortune Scholarship Foundation; or Any other matter relating to the Fortune Scholarship Foundation or this Applicant Agreement.
The above limitation is applicable even if Fortune Spark or its authorized representatives have been advised of (or know or should know of) the possibility of such damages.
Trademark Information Fortune Scholarship® and the Fortune Scholarship logo are trademarks of Fortune Spark.. Other Fortune Spark trademarks, as well as any third-party trademarks, service marks, logos and trade names appearing on this Web site or on or through the Fortune Scholarship Foundation, are the property of their respective owners.
